Dusty Plains Studio Terms of Service

These Terms of Service apply to all design and creative projects undertaken by Dusty Plains Studio. By engaging our services, you agree to the terms outlined below. If you have any questions or would like to discuss specific terms, feel free to get in touch — we're always happy to chat.


payment terms

Deposits & Final Payments

Dusty Plains Studio reserves the right to request a 50% deposit before commencing work. An invoice will be emailed, and payment is due within 15 days. By making this payment, you accept these Terms of Service and enter into a contract with Dusty Plains Studio.

The remaining balance will be invoiced before the final assets are delivered. All project files will be withheld until full payment has been received.

If you become uncontactable or unresponsive for more than 15 days, Dusty Plains Studio reserves the right to issue the final invoice early and suspend work until contact is re-established.

All invoices must be paid within 15 days of issue. Late payments may incur additional fees or result in debt recovery action, for which you may be held responsible.

Payment plans may be available upon request and must be agreed upon in writing by both parties.


Ownership & Usage Rights

All preparation materials, sketches, and unused concepts remain the intellectual property of Dusty Plains Studio. Full usage rights for the final agreed design(s) are transferred to you upon final payment.

Unless otherwise agreed in writing, Dusty Plains Studio retains the right to showcase the completed project (and any unused concepts) in our portfolio, on social media, and in printed or online publications.

You are free to modify your final design(s) as you see fit, but you do so at your own risk. We recommend consulting a designer for any significant alterations.

Final payment ensures that ONLY the agreed logo design becomes your property. Any previous ideas/concepts remain Dusty Plains Studios unless any prior agreement has been made.


CopyRight

The final artwork becomes your property only upon receipt of full payment. If payment is not received, Dusty Plains Studio retains ownership of all files and reserves the right to reuse or adapt the designs for other projects or portfolio work.

We reserve the right to pursue legal action if any unpaid work is used, modified, replicated, or distributed.

If your project is under NDA or requires secrecy, please inform us before the project begins so we can make suitable arrangements.


Project Cancellation & Suspension

Client-Initiated Cancellation

If you cancel the project after work has begun, deposits are non-refundable. However, Dusty Plains Studio may offer partial refunds depending on the work completed and at its discretion.

Studio-Initiated Suspension

We reserve the right to suspend or terminate a project if ongoing micromanagement, excessive revision requests, non-payment, or a breakdown in communication or trust hinders it.

You will be notified and given a fair opportunity to remedy the situation before any suspension occurs. No refunds will be given for suspended projects. All completed work will remain the property of Dusty Plains Studio unless otherwise agreed.

Force Majeure

If we are unable to fulfill any part of this agreement due to events beyond our control (e.g., natural disasters, government restrictions, illness, or other disruptions), this will not be considered a breach of contract. We will notify you as soon as possible and resume work once the situation permits.


Limitation of Liability

Dusty Plains Studio is not liable for any loss or damage related to using our services or deliverables, including errors, omissions, or reliance on provided content.

While we take great care to ensure our work is original, we recommend that you conduct your own due diligence for trademarks, naming rights, and plagiarism concerns. We perform basic checks but are not responsible for legal outcomes.


Naming and Trademark Responsibility

Clients are responsible for ensuring that their chosen business or product name is legally available. Please verify this before we begin any design work.

If a name change is required mid-project, additional fees may apply to compensate for work already completed. Dusty Plains Studio is not liable for any legal complications caused by name or trademark issues.
